All orders placed on this Web Site are subject to acceptance in accordance with these terms and conditions. Acceptance of your order and the completion of the contract between you and Telmap Direct will only take place on despatch of the goods or services ordered.
Telmap Direct make every effort to deliver goods within the estimated timescales, but delays can occur and Telmap Direct shall have no liability for any delay or failure to deliver the goods or services ordered within the estimated timescales.
Risk of damage to or loss of any particular goods supplied by Telmap Direct to you will pass to you on delivery of those goods or, if you wrongfully fail to take delivery of those goods, the time when those goods are tendered for delivery. Ownership of any particular goods shall not pass to you until Telmap Direct has received (in cash or cleared funds) payment in full of all sums due.
Telmap Direct shall not be liable for any delay or failure in performing any of its obligations under the agreement if the delay or failure was due to any cause beyond Telmap Direct’s reasonable control.
Save as expressly provided in these terms and conditions and except where the goods are sold to a person dealing as a consumer (within the meaning of the Unfair Contract Terms Act 1977) all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.
Any Software that is made available to download from this Web Site (“Software”) is the copyrighted work of Telmap Direct and/or its licensors, or suppliers. Your use of the Software is governed by these Terms and Conditions and the terms of the end user license agreement, if any, which accompanies or is included with the Software (“License Agreement”). To the extent that the License Agreement conflicts with these Terms and Conditions, the terms of the License Agreement shall govern your use of the Software. You may not install or use any Software that is accompanied by or includes a License Agreement unless you first agree to the License Agreement.

Telmap Direct may transfer, assign, novate or sub-contract the benefit of all or any of its rights under these terms and conditions or any contract subject to these terms and conditions to any third party.
No waiver by Telmap Direct of any breach of the agreement by you will be treated as a waiver of any subsequent breach of the same or any other provision.
Variations to these terms and conditions will only be effective if in writing and signed by an authorised representative of each of Telmap Direct and you.
Telmap Direct’s employees or agents are not authorised to make any representations concerning goods unless confirmed by Telmap Direct in writing.
B. The Following Additional Terms Apply To Consumers Only
Where an order is placed via this Web Site, Telmap Direct has a statutory obligation to give certain information to you in writing or other durable medium in relation to such order at the latest at the time of delivery. This information is provided either on the relevant invoice or in these terms and conditions. In particular, a description of the main characteristics of the goods being supplied, the price (including all taxes) and delivery costs (if applicable) will be set out on the relevant invoice.
Subject to the exceptions set out in clause 3 below, you have a statutory right under the Consumer Protection (Distance Selling) Regulations 2000 (“the Regulations”) to cancel any order which has been accepted by Telmap Direct by giving notice in writing to the address shown on the invoice and marked for the attention of the Customer Services Manager. Unless any other time limit applies under the Regulations, the notice must be received within 7 working days following the day on which the goods which are the subject of the order being cancelled are delivered, unless the reason for such cancellation is shortage, damage, defect in quality or condition, failure to correspond with order or non delivery in which case notice should be given and must be received within 30 days following the day on which the goods are delivered.
You may not cancel any order which has been accepted by Telmap Direct, where such order is for computer software, if such computer software has been unsealed by you.
If an order is cancelled you must return the goods concerned to the address shown on the invoice marked for the attention of the Customer Services Manager within 14 days of giving notice of cancellation of the order. Where such return is for reasons other than shortage, damage, defect in quality or condition, failure to correspond with order or non-delivery this will be at your expense and liability.
Telmap Direct will reimburse any sum paid by you for or in relation to the goods as soon as possible following receipt of notice of cancellation given in accordance with the appropriate time limit and in any case within 30 days of receipt of such notice. Other than in the case of cancellation for shortage, damage, defect in quality or condition, failure to correspond with order or non delivery (where the reasonable costs of returning the goods by the mechanism agreed with Telmap Direct will be reimbursed) this will not include reimbursement of the costs of returning the goods.
Any complaints should be sent in writing to the address shown on the invoice marked for the attention of the Customer Services Manager.
If any goods ordered by you are to be delivered to a third party, then delivery to such third party shall be treated as delivery to you and all relevant provisions of these terms and conditions shall apply accordingly.
Where the goods are sold to a consumer the consumer’s statutory rights are not affected by these terms and conditions.
